MULTIPLE INJURY TRUST FUND ASSESSMENT
NOTICE OF NEW ASSESSMENT RATE: The Multiple Injury Trust Fund (MITF) assessment rate to be charged for the four quarter period of 7/1/2012 through 6/30/2013 has been calculated as provided by law. OKLAHOMA TREATMENT GUIDELINES ON SCHEDULE II DRUGS ADOPTED EFFECTIVE APRIL 2, 2012
Oklahoma Treatment Guidelines (OTG) for Use of Schedule II Drugs as contained in the Uniform Controlled Dangerous Substances Act have been adopted by the Physician Advisory Committee pursuant to 85 O.S., §373(B)(6) and approved by the Workers' Compensation Court Administrator, effective/operative on April 2, 2012. Unless otherwise determined by a court of law, Physician Advisory Committee treatment guidelines regarding chronic pain and for prescription of opioid medications for acute and chronic pain that were adopted before August 26, 2011 remain in effect until the OTG become effective on April 2, 2012

COURT RULES APPROVED BY SUPREME COURT
Workers' Compensation Court rule changes were approved by the Oklahoma Supreme Court by order filed on March 6, 2012, and became effective as of that date. 2012 OK 19. WORKERS' COMPENSATION COURT ADMINISTRATOR RULE CHANGES APPROVED
Workers' Compensation Court Administrator Rule 1 on medical costs and Rule 4 on mediation were deleted by order of the Presiding Judge, effective March 13, 2012. These Administrator's rules were deleted because the subject matter is now addressed in recently amended Court Rule 50 (Disputes Regarding Payment For Health Or Rehabilitation Services) and Court Rule 53 (Mediation Process and Fees). SPECIAL ADVISORY NOTICE REGARDING USE OF OFFICIAL DISABILITY GUIDELINES (ODG) FOR CARE OF INJURED WORKERS
This is a special advisory notice concerning use of the Official Disabilities Guidelines (ODG) for care of injured workers. It supercedes the previously distributed March 1, 2012 notice regarding use of the ODG.
The Work Loss Data Institute’s Official Disability Guidelines (ODG) was adopted as the standard for determining the scope and duration of medical treatment in workers’ compensation effective March 1, 2012. See 85 O.S., §326(G). For information about Work Loss Data Institute, visit www.worklossdata.com or contact Work Loss Data Institute at 1-800-488-5548. To order ODG, call 1-800-488-5548 or go to www.worklossdata.com/orderform_ok.htm. The ODG is not available for purchase from the Court.
Oklahoma Treatment Guidelines (OTG) developed by the state Physician Advisory Committee and adopted as provided by law, govern medical care not covered by the ODG or not recommended by ODG for injuries to the cervical, thoracic or lumbar spine, and for continuing medical maintenance or pain management, once the OTG become operative. See 85 O.S., §326.
At this time, OTG for the spine are being developed by the Physician Advisory Committee. They are subject to a multi-tiered review process and become operative 30 days after adjournment of the Oklahoma Legislature, unless disapproved as provided by law. See 85 O.S., §373(B)(5). Notice of the operative date or disapproval of these OTG will be posted on the Workers’ Compensation Court’s web site at http://www.owcc.state.ok.us/whats_new.htm.
OTG for use of Schedule II Drugs have been adopted by the Physician Advisory Committee pursuant to 85 O.S., §373(B)(6) and approved by the Court Administrator, effective/operative on April 2, 2012. Go to http://www.owcc.state.ok.us/whats_new.htm to access these guidelines.
Unless otherwise determined by a court of law, treatment guidelines for the spine and regarding chronic pain that were adopted by the Physician Advisory Committee before August 26, 2011 remain in effect until the OTG become operative or if disapproved. The Workers' Compensation Court Administrator has adopted a new workers' compensation fee schedule effective January 1, 2012. The schedule was adopted per Title 85, Oklahoma Statutes, Section 327. Mileage Reimbursement Rate for 2012 – Stays the Same
The Internal Revenue Service has announced that the mileage reimbursement rate will continue at $0.555 per mile for 2012. (See Internal Revenue Bulletin IR-2011-166, December 9, 2011, amending Internal Revenue Procedures 2010-51).
